Terms of Service

Effective: May 16, 2026

These Terms of Service ("Terms") govern your access to and use of Down to Detail (the "Service"), a software product operated by Down to Detail. By creating an account, you agree to these Terms.

1. Account & eligibility

  • You must be 18+ and legally capable of entering a contract in your country.
  • Provide accurate information when signing up — we may suspend accounts with falsified data.
  • You're responsible for keeping your password secret and for everything that happens under your account.
  • One person per account. Inviting employees to your workspace is allowed (see Section 4); sharing your password is not.

2. Free trial & payment

  • New accounts get a 14-day free trial. A valid payment method is required to start the trial.
  • Your first charge happens on day 15 at the plan rate you selected.
  • Subscriptions auto-renew at the end of each billing cycle until canceled.
  • Cancel anytime from Settings → Subscription. Cancellation stops future charges; access continues until the end of the current paid period.
  • One trial per person: if you cancel and re-subscribe later, no second trial — you're charged immediately.
  • Prices are in USD. Currency conversion (if any) is handled by Stripe.

3. Refunds

  • Cancel during your trial → not charged. No refund needed.
  • Cancel after charge but within 30 days of your first payment → email us for a full refund, no questions asked.
  • Past 30 days → cancellation stops future renewals but past charges are non-refundable.

4. Workspace members

  • Pro plan: up to 2 employees can join your workspace via an invite code.
  • Team plan: up to 8 employees.
  • Workspace members inherit your subscription — they don't pay separately.
  • You (the owner) are responsible for your members' actions inside your workspace.
  • Sharing or selling invite codes outside your business is grounds for termination.

5. Acceptable use

You agree not to:

  • Use the Service to harass, defraud, or spam anyone (including via SMS or AI-generated content)
  • Send messages without the recipient's consent in violation of TCPA or similar laws
  • Upload illegal content, malware, or anything that violates someone else's rights
  • Reverse-engineer, scrape, or circumvent security controls
  • Resell access to the Service without our written permission

Violations may result in immediate suspension. We'll tell you why before terminating where possible.

6. Your content

  • You retain ownership of everything you upload (client lists, photos, notes, etc.).
  • You grant us a limited license to host, process, and display your content so the Service works.
  • We do not use your content to train AI models or share it with advertisers.
  • On account deletion we erase your content within 30 days (cached backups expire shortly after).

7. SMS & messaging

  • You're responsible for getting consent from each client before sending them texts via the Service.
  • Carriers may flag, throttle, or block messages that look like spam. We're not liable for delivery failures caused by carrier filtering.
  • Standard messaging rates may apply on your provider (Twilio, GHL) account.

8. AI features

  • AI cleaning expert, walkthrough structuring, and marketing generation are powered by third-party models (currently Anthropic).
  • AI output may be inaccurate — always verify before acting on it (e.g. don't use the wrong cleaner on a stain because AI guessed).
  • Per-month usage caps apply per your plan. Exceeding them prompts an upgrade or one-time Boost purchase.

9. Service availability

We aim for 99.5% uptime but don't guarantee it. Planned maintenance is rare and announced in advance when possible. We're not liable for losses caused by downtime.

10. Limitation of liability

To the maximum extent permitted by law, Down to Detail is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow these limits — they apply only where enforceable.

11. Termination

  • You may close your account anytime from Settings.
  • We may suspend or terminate accounts that violate these Terms, with notice where possible.
  • Outstanding fees survive termination.

12. Changes to these Terms

We may update these Terms. Material changes will be notified via email + in-app notification with at least 14 days' notice. Continued use after changes take effect = acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, USA. Disputes go to courts located in New York County, NY — though we'd much rather resolve anything by email first.
